DEFINITION OF LEAVE

“Leave” means any period during which a staff is allowed to leave his job and the leave is not counted as a termination of service or as a resignation.

DEFINITION OF ANNUAL LEAVE

“Annual Leave” means full paid leave granted for qualifying service in a given year from January to December.

QUALIFIING SERVICES

"Services that qualify" means a service which is taken into account for calculating the entitlement to leave an officer and consists of time - time duty, vacation leave and sick leave [and for teachers - teachers, including school holidays full salary] but not including partially paid leave, holidays without pay, pilgrimage leave, tuberculosis, leprosy and cancer leave and study leave.

CALCULATION OF ELIGIBLE ANNUAL LEAVE

Total DAYS served / 365 days X leave entitlement (for one year)

  1. The calculation is subject to the date of appointment of the staff (the date the staff begins to report for duty). The same method can also be used for staff who report back to work after study leave (coursework), sabbatical leave, unpaid leave, half pay leave, pilgrimage leave or leave for a period of leave that does not qualify for annual leave.
  2. For any staff in a year of service that is less than one (1) year, then the annual leave for qualified staff is the amount of leave for the qualifying period of service only. For example, new staff serve or resign in the middle of the year or take other leave entitlements that do not entitle them to annual leave.

ZERO CALCULATION OF ANNUAL LEAVE ELIGIBILITY

  1. This leave is used as a guide for staff to determine their leave entitlement for a calendar year.
  2. The Head of Department shall ensure that staff take time off according to the qualifying period of service. However, taking leave in excess of entitlement may be considered by the Head of Department subject to the importance of the service.

APPLYING ANNUAL LEAVE

  1. Application to use leave must be made through the online system of Human Resource Information System (SMSM) - Leave.
  2. Under normal circumstances, a staff member may only take leave of absence to the extent of qualifying service. However, taking leave in excess of entitlement may be considered by the Head of Department subject to the importance of the service.
  3. If it is found that a staff member is taking leave in excess of his entitlement, then he shall reimburse (either through salary deduction or direct payment) to the University equivalent to one day of emoluments for each day of such excess leave.
  4. The number of days taken will be given the status of Leave Without Pay and deducted from the Leave Without Pay of qualified staff under General Order 14 Chapter C, 1974. Staff may be subject to disciplinary action.

SPP No. 4/2009 (Item 5.1 (u))

Staff can only take qualified leave of absence before leaving service (resignation/ retirement).

CONDITIONS OF COLLECTABLE ANNUAL LEAVE

  1. Due to the importance of service
  2. Annual leave in the first year that cannot be spent can be carried over to the next year and will expire at the end of the third year.

ANNUAL LEAVE REWARD (GCR)

"The cash award in lieu of leave will only be given to any public officer who retires or dies in Government service provided that the balance of the accumulated annual leave cannot be spent in the current year in the interest of service."

CONDITIONS FOR COLLECTABLE OF ANNUAL LEAVE (GCR)

  1. Permanent appointment.
  2. The amount of leave that can be accrued in a year is a maximum of 15 days or half of the qualifying leave rate for that year, whichever is less. (PP No. 7 of 2003 (5))
  3. The total annual leave can be accumulated a maximum of 150 days for the GCR 'award’. (PP No. 18 of 2008 (4))
  4. At the end of the year of service, staffs are allowed to accumulate CR for the GCR 'award' up to a maximum equal to the qualified CR rate.
